Wedding Photography & Videography Services Agreement

TEAM STRUCTURE
For photography services, SW INC. will contract a trusted and experienced professional photographer under this agreement. This photographer will operate on behalf of SW INC. and follow the stylistic direction and quality standards expected from all SW INC. deliverables. Videography will be provided by Sam Wheeler (SW INC. owner) unless otherwise stated. Clients agree that any subcontracted team members will act with full authority and under the creative and professional supervision of SW INC.

DELIVERABLES
SW INC. will provide Clients with high-resolution edited photographs and a professionally produced wedding film (style and duration to be agreed upon in booking). All deliverables will reflect SW INC.’s artistic and editorial approach as displayed in its public portfolio. Clients understand and agree that editing, style, pacing, and the selection of included footage and photographs are at the sole discretion of SW INC. and its contracted team.

NO RAW OR LOG FILES
Under no circumstances will SW INC. provide Clients with RAW or unedited image files or video footage. All delivered content will be professionally edited and formatted for viewing. RAW files and footage are the intellectual property of SW INC. and will not be released, ensuring quality control and artistic integrity.

PHOTO SELECTION & CULLING
Not all images or footage captured during the event will be included in the final delivery. SW INC. and its photography contractor will review, select, and edit only the best moments. Clients understand that duplicate, blurred, or test shots will be removed in the editing process, and that a specific number of photos or video length is not guaranteed unless stated in a separate service outline.

DEADLINES & STORAGE
Final photo and video deliveries will be made digitally unless otherwise agreed upon. All RAW files will be deleted within 30 days of final delivery to ensure data security and reduce long-term storage costs. Clients are responsible for backing up all files after they are delivered, as SW INC. cannot guarantee long-term file storage.

MEALS FOR VENDORS
If services exceed six (6) hours, Clients agree to provide one (1) meal per on-site vendor, including any contracted photographer and the lead videographer. This ensures smooth operation without interruption during full-day coverage.

PERMITS, FEES & LOCATION ACCESS
If any shoot location—whether for wedding, engagement, or content creation—requires permits, entry fees, or specific access, Clients are solely responsible for securing access and paying all related costs. Delays or restrictions caused by lack of access are not the responsibility of SW INC.

DELIVERY SERVICES
If physical delivery (USB drives, hard drives, etc.) is requested, SW INC. is not responsible for any loss or damage caused by third-party delivery carriers. Clients must provide accurate addresses and accept all shipping risks. Replacements may incur an additional fee.

COPYRIGHT & USAGE RIGHTS
All photos and video content created under this agreement remain the exclusive copyrighted property of SW INC. Clients are granted a personal, non-commercial license to display, print, and share their photos and film. Clients may not resell, alter, or authorize third-party use without SW INC.’s written consent. SW INC. retains the right to use photos and video for portfolio, website, social media, and other promotional purposes.

CREATIVE CONTROL & LIMITATIONS
Clients acknowledge that SW INC. retains full creative and editorial control over how the wedding is captured and edited. While special moments and requests will be considered, SW INC. cannot guarantee the capture of any specific moment, person, or pose due to the unpredictable nature of live events.

WEDDING DATE CHANGES
If Clients request a date change, SW INC. will apply the original non-refundable 30% deposit toward the new date only if both the videographer and contracted photographer are available. If availability is not possible, the deposit will be forfeited and the agreement terminated.

CONDUCT & HARASSMENT
Clients agree to provide a respectful and safe working environment. Any form of harassment, discrimination, or unsafe behavior directed toward SW INC. or its subcontracted photographer will result in immediate termination of services without refund. This includes verbal abuse, sexual harassment, and physical intimidation.

SUBSTITUTIONS & EMERGENCIES
In the rare event that SW INC. or the contracted photographer becomes unavailable due to illness, injury, death, emergency, or act of God, SW INC. will make every effort to secure a qualified replacement. If no substitute is available, all fees paid, including deposits, will be refunded in full. This shall be the sole remedy.

BREACH OF CONTRACT
Failure to comply with the terms in this agreement—including timely payment, communication, or respectful conduct—may result in termination of services. SW INC. reserves the right to cancel services and retain all fees paid if the Clients breach any portion of this agreement.
