Music & Arts Videography Services Agreement
(Videography-Only Package – Full Music Video & Promotional Clips)
Delivery Format
Clients will receive a fully edited music video in high-definition digital format, along with up to three short-form promotional clips suitable for social media use. Raw, unedited footage will not be released under any circumstances. The editing process is considered part of SW INC.'s creative service, and final delivery reflects the full artistic vision of the filmmaker.
Creative Control & Editing Style
SW INC. retains complete creative and editorial authority over all aspects of filming, editing, pacing, transitions, sound design, and color grading. Clients acknowledge that video content will reflect SW INC.'s unique style and creative direction, consistent with previous work presented to the client. Requests for revisions will be considered at SW INC.'s discretion and may incur additional fees depending on scope.
Turnaround Time
Delivery of the final video and promotional content will be completed within a mutually agreed timeframe following the event date, typically within 4–6 weeks unless otherwise discussed. SW INC. will communicate any delays due to unforeseen circumstances.
Client Cooperation & Communication
Clients agree to provide any required materials (music tracks, branding elements, references, etc.) at least one week before filming. Clients understand the importance of clear and timely communication before, during, and after the shoot. SW INC. operates during standard business hours and may not respond to inquiries outside of these times.
File Storage & Responsibility
Final edited videos will be stored by SW INC. for 30 days following delivery. It is the client's responsibility to download and back up files. SW INC. is not responsible for lost or deleted videos after the storage period expires.
Location Access & Permits
Clients are solely responsible for securing filming access, location permits, parking passes, and any associated fees for chosen venues. SW INC. is not responsible for delays, fines, or access denial due to incomplete location arrangements.
Meal Provision (If Applicable)
For any filming sessions lasting over six consecutive hours, clients agree to provide one meal per videographer present. This helps maintain consistent focus and performance throughout the day.
Copyright Ownership & Usage License
All video footage and final edits are the exclusive copyrighted property of SW INC., protected under U.S. Copyright Law and the Illinois Visual Artists Rights Act.
Clients are granted a non-exclusive, limited-use license to distribute and share the final content for promotional, portfolio, and social media use.
Clients may not edit, remix, sell, or sublicense any footage without written permission. SW INC. retains full rights to use all footage for its own promotional, editorial, advertising, and portfolio purposes.
Date Changes & Rescheduling
If the shoot date must be rescheduled, the original 30% non-refundable deposit will apply to the new date only if SW INC. is available. If unavailable, the deposit will be forfeited and the agreement void. Clients must confirm rescheduling at least 7 days in advance to avoid additional charges.
Safety & Conduct Policy
SW INC. maintains a zero-tolerance policy for any harassment, hostility, or inappropriate behavior directed toward its team. This includes but is not limited to verbal abuse, physical intimidation, and discriminatory actions. SW INC. reserves the right to stop filming immediately if team safety is compromised. No refunds will be issued in such cases.
Force Majeure & Substitution
If SW INC. is unable to perform due to illness, emergency, equipment failure, or force majeure, reasonable efforts will be made to provide a substitute videographer. If no substitute is available or acceptable to the client, this agreement will be terminated and any paid fees will be refunded. This refund will serve as the sole remedy.
Creative Limitations & Expectations
SW INC. will document the session based on the client's vision and available resources, but cannot guarantee the capture of any specific shot or scene. The client understands that videography is subject to creative interpretation and external conditions. Final editing decisions, pacing, shot inclusion, and artistic direction are left to the discretion of SW INC.
Breach of Agreement
If the client violates any term of this agreement, SW INC. reserves the right to terminate services and retain all paid fees. Grounds for breach include but are not limited to non-payment, failure to cooperate, or misconduct as defined in the safety clause.
