Athletic Photography Services Agreement

RAW PHOTOS
Under no circumstances will SW INC. release RAW, unedited, or original image files to Clients. All final image deliveries will be in high-resolution JPEG format only. Clients acknowledge that the editing process is a core part of SW INC.’s artistic service and final product.

PHOTO DELIVERY & EDITING
All photographs taken by SW INC. during the game are subject to a professional selection (culling) and editing process. SW INC. retains full creative and editorial control over which images are selected and how they are edited. Clients acknowledge that not all photographs taken during the game will be included in the final gallery. SW INC. does not guarantee a minimum number of images. Editing style will be consistent with SW INC.’s sports photography portfolio.

FILE STORAGE & RESPONSIBILITY
All RAW and unedited photo files will be deleted from SW INC.’s storage systems 30 calendar days after final delivery of the edited gallery. Once final files are delivered, Clients are solely responsible for backing up and storing the files. SW INC. is not liable for any data loss after delivery.

GAME LOCATION FEES & ACCESS
Clients are responsible for obtaining necessary permissions, passes, or credentials required to access the game venue for photography purposes. If the location requires any administrative or access fees, the Client must provide or reimburse SW INC. accordingly.

COPYRIGHT & USAGE RIGHTS
All photographs produced under this agreement remain the sole copyrighted property of SW INC. SW INC. retains full rights to use the photos for promotional, marketing, portfolio, editorial, and advertising purposes in both digital and print format. Clients are granted a personal, non-exclusive license to use the delivered images for non-commercial purposes, including personal prints and online sharing. Clients may not edit, sell, or authorize third-party use of the images without written consent from SW INC.

SCHEDULING, RESCHEDULING & CANCELLATIONS
If the scheduled game is postponed or rescheduled, SW INC. will make reasonable efforts to accommodate the new date, provided availability. If SW INC. is unavailable for the rescheduled date, the agreement will be canceled, and the non-refundable deposit will be forfeited. Cancellations within 48 hours of the game may be subject to full payment due to loss of booking opportunities.

COMMUNICATION & COOPERATION
Clients agree to maintain positive, respectful, and responsive communication before, during, and after the game. SW INC. may not be available for instant communication outside of standard business hours but will respond promptly to reasonable requests.

HARASSMENT & SAFETY
SW INC. maintains a zero-tolerance policy for harassment or inappropriate conduct directed toward photographers by Clients, spectators, or venue staff. If any SW INC. team member feels unsafe or uncomfortable and the issue is not resolved, SW INC. reserves the right to immediately cease photography services. No refunds will be issued under these circumstances.

SUBSTITUTION & FORCE MAJEURE
In the rare event that SW INC. cannot perform its obligations under this agreement due to illness, emergency, equipment failure, or any act beyond its control, SW INC. will attempt to provide a qualified replacement photographer. If no substitute is available, all fees paid will be refunded in full. This is the sole remedy in such an event.

CREATIVE DISCRETION & LIMITATIONS
SW INC. will document the game to the best of its ability, focusing on the individual athlete as outlined in the package. However, due to the unpredictable nature of live sports, specific moments or angles cannot be guaranteed. Final image composition, lighting choices, and editing style are at the full discretion of SW INC.

BREACH & TERMINATION
If Clients breach any terms of this agreement, SW INC. reserves the right to terminate the agreement and retain all fees paid. Termination may result from, but is not limited to: non-payment, failure to provide required access, or misconduct as described above.

By signing below, both parties acknowledge and agree to the terms outlined in this Sports Photography Services Agreement.
