Music & Arts Photo + Video Services Agreement
(Fully Edited Photo & Music Video Package)

DELIVERABLES
Clients will receive:
– A curated gallery of fully edited, high-resolution JPEG images.
– One fully edited music video in high-definition digital format.
– Up to three short promotional video clips for social media use.
Under no circumstances will SW INC. release RAW photos, unedited video footage, or project files. All final products reflect the completed creative work of SW INC. Editing is considered an essential part of the artistic service provided.

CREATIVE CONTROL
SW INC. retains full creative direction and editorial discretion over the capture, editing, and delivery of all photos and video content. This includes composition, selection, editing style, pacing, transitions, sound design, and color. Clients acknowledge that the final results will reflect SW INC.'s visual and narrative style, consistent with previously shared portfolios.

TURNAROUND TIME
Typical delivery is within 4–6 weeks of the event date. Any delays due to illness, high season workload, or unforeseen events will be communicated in advance. SW INC. is not responsible for meeting third-party publishing or submission deadlines unless agreed to in writing.

REVISIONS
One round of minor revisions to the music video may be requested within 7 days of delivery. Major edits or additional changes may incur additional fees and are subject to availability.

CLIENT RESPONSIBILITIES
Clients must provide all relevant materials (such as music licensing, reference ideas, or branding assets) no later than 7 days before the event. Clients are expected to communicate clearly and respectfully before, during, and after the shoot. SW INC. operates within standard business hours and may not respond to messages immediately outside of those times.

FILE STORAGE & DOWNLOADS
Final edited files will be available for digital download and stored by SW INC. for 30 days following delivery. After this period, SW INC. is not responsible for file loss. Clients are solely responsible for creating their own backups of all delivered files.

LOCATION PERMITS & FEES
Clients are responsible for acquiring all necessary filming or photography permits, paying access or location fees, and securing entry to private or restricted venues. SW INC. will not be held responsible for delays, cancellations, or inability to shoot due to access restrictions.

MEALS & COVERAGE
For coverage exceeding six (6) hours, Clients agree to provide one hot meal per SW INC. team member. This ensures consistent, uninterrupted service throughout the day.

COPYRIGHT & LICENSE
All photos and video content created under this agreement are the sole intellectual property of SW INC., protected under U.S. copyright law and the Illinois Visual Artists Rights Act.
SW INC. retains the right to use any photo or video for promotional, portfolio, editorial, social media, and marketing purposes.
Clients receive a non-exclusive, non-commercial license to use the final content for personal promotion, printing, and online sharing. Clients may not alter, sell, or authorize third-party use of the material without written permission from SW INC.

DATE CHANGES & RESCHEDULING
If the event date changes after the agreement is signed, the 30% non-refundable deposit will transfer to the new date only if SW INC. is available. If unavailable, the agreement is void and the deposit is forfeited. Any rescheduling must be confirmed at least 7 days in advance.

CONDUCT & SAFETY POLICY
SW INC. upholds a zero-tolerance policy for harassment, discrimination, or threatening behavior directed toward its staff. This includes inappropriate conduct from clients, guests, or venue personnel. If safety becomes compromised and the issue is not immediately resolved, SW INC. reserves the right to leave the premises without issuing a refund.

FORCE MAJEURE & SUBSTITUTION
In cases of emergency, illness, injury, equipment failure, or acts of nature, SW INC. will make every reasonable effort to secure a qualified replacement. If no substitute is available, a full refund of all paid fees, including the deposit, will be issued. This refund is the sole remedy.

LIMITATIONS OF COVERAGE
While SW INC. will make every effort to capture important moments, Clients acknowledge that live events are unpredictable. No specific shot, person, or scene is guaranteed. Final coverage will reflect real-time conditions, available lighting, timing, and access granted on the day of the event.

BREACH OF AGREEMENT
If the Client breaches any portion of this agreement, including but not limited to non-payment, hostile conduct, or failure to provide access, SW INC. reserves the right to terminate services and retain all fees paid. No refunds will be issued for breach-related terminations.
